SMS TERMS & CONDITIONS

These SMS Terms & Conditions (“SMS Terms”) govern participation in the text messaging program(s) offered by Jewish Community Center of MetroWest, Inc. (“JCC MetroWest,” “we,” “us,” or “our”). By opting in to receive SMS/text messages from JCC MetroWest, you agree to these SMS Terms and our Privacy Policy.
1. PROGRAM DESCRIPTION
JCC MetroWest may send recurring automated or non-automated informational and marketing text messages to individuals who voluntarily opt in. These may include:
Program and class reminders
Event information, updates, and community announcements
Membership, camp, and youth program notifications
Fundraising, development, and promotional marketing
Emergency, weather-related, and operational alerts Message frequency may vary.
2. USER CONSENT & THE “AUTOMATIC DIALING” DISCLOSURE
By providing your mobile phone number and opting in, you expressly consent to receive recurring text messages from JCC MetroWest, including messages sent using an automatic telephone dialing system (ATDS) or similar technology.
Non-Contingency: Consent is not a condition of membership, donation, purchase, enrollment, or participation in any program.
Authority: You represent that you are the authorized user of the mobile number provided.
3. DUTY TO NOTIFY (CHANGE OF NUMBER)
You agree to notify JCC MetroWest immediately if you change your mobile telephone number or if you are no longer the primary user of the number provided. This is a material condition of these SMS Terms. You may notify us of a number change by contacting [email protected].
4. MESSAGE AND DATA RATES
Message and data rates may apply according to your mobile carrier plan. JCC MetroWest is not responsible for any messaging or wireless charges incurred by you.
5. OPTING OUT (REVOCATION OF CONSENT)
You may opt out of SMS communications at any time by replying: STOP
Confirmation: After sending STOP, you will receive one final text message confirming that you have been unsubscribed.
Scope: If you are enrolled in multiple JCC SMS programs (e.g., both “Camps” and “Fitness”), you may need to opt out of each program separately unless the system provides a global “STOP ALL” option.
Non-SMS Contact: Opting out of SMS will not prevent us from contacting you via email or phone for essential transactional or safety matters.
6. HELP AND SUPPORT

7. PARTICIPATING CARRIERS & LIABILITY
Supported carriers may change without notice. Mobile carriers are not liable for delayed or undelivered messages. The SMS program is provided on an “as is” and “as available” basis, and we do not guarantee uninterrupted or error-free delivery of messages.
8. PRIVACY
Information collected is subject to our Privacy Policy. We do not sell, rent, or share mobile phone numbers or SMS consent data with third parties or affiliates for their own marketing purposes.
9. ELIGIBILITY
You must be at least 18 years old to enroll. If you are under 18, you must have the express permission of a parent or legal guardian.
10. DISPUTE RESOLUTION & ARBITRATION
To the fullest extent permitted by applicable law, any disputes arising out of or relating to these SMS Terms or the SMS program shall be resolved through binding individual arbitration in the State of New Jersey. You agree to waive any right to participate in class-action litigation or class-wide arbitration.
11. LIMITATION OF LIABILITY
JCC MetroWest shall not be liable for any delays, failures, or inaccuracies in SMS delivery or for any damages arising from your participation in the SMS program.
